1.7(h) Golf carts must be operated on cart paths where provided. Golf carts shall be kept on cart paths around all tees and greens. Golf carts shall not be driven within 20 metres of any green or within 20 metres of any tee except on an established cart path.
First Offence – in the first instance of a Member being in breach of Rule 1.7(h) (the Rule):
- The Match and Greens Committee, within seven (7) days of being notified of the offence taking place will issue a warning notice to the contravening Member setting out:-
- the circumstances surrounding how, where and when the Member has contravened the Rule;
- that the Member does not contravene the Rule again; and
- that should the Member contravene the Rule on a second occasion, the consequences of the Second Offence will apply.
Second Offence – in the second instance of a Member being in breach of the Rule:-
- The offending Member, within five (5) days of the breach being notified to the Match and Greens Committee, will be provided with a formal breach notice, which sets out:-
- the circumstances surrounding how, where and when the Member’s second contravention of the Rule occurred;
- that the Member has already been provided with a warning notice for a First Offence;
- that, as a result of the Second Offence, the Member’s membership is suspended for a period of two (2) weeks commencing from the date of the notice (Second Offence Suspension); and
- that the Member has a right to appeal the Second Offence Suspension in accordance with the rules set out under the Rule.
- if the Member exercises its right to appeal the Second Offence Suspension, the Member is made aware that the Second Offence Suspension remains in force until such time as the Match and Greens Committee of the Club resolves to lift the suspension.
- Should a Member wish to appeal the Second Offence Suspension, the Member needs to submit a written notice to the Match and Greens Committee setting out the reasons as to why the Member does not consider the Second Offence Suspension is appropriate. Upon receipt of this notice, the Match and Greens Committee will call a meeting with the Member to determine the course of action to be taken.
- The meeting called with the Match and Greens Committee and the offending Member (the Meeting) must take place within seven (7) days after the letter of offence has been issued as above in item 2(a). The Member may bring a support person to the Meeting.
- The Meeting is to be recorded via minutes.
- At the Meeting, the Member who is deemed to have contravened the Rule will be provided with the opportunity to address the Match and Greens Committee to provide any cause or justification surrounding the contravention for consideration by the Match and Greens Committee of the Club.
- The Match and Greens Committee must consider any reasoning provided by the Member as to whether such reasoning excuses the breach by the Member;
- The Match and Greens Committee, after taking into consideration the reasoning behind the second breach as provided by the contravening Member, is to provide to the contravening Member by written notice within three (3) days of the Meeting:-
- The decision made by the Match and Greens Committee with respect to the alleged second breach; and
- If the Match and Greens Committee determines the Member did breach the Rule for the second time, such notice to the contravening Member is to be inclusive of the length of suspension applicable to the breach and the consequence should a Third Offence occur.”
The Match and Greens Committee, at all times during the consideration of the suspension applicable to the breach of the Rule by the contravening Member, must come to a decision via majority vote. Failure for the Match and Greens Committee reaching a majority decision will result in the matter being referred to the Executive General Manager for final determination.
Third Offence – Recommendation to the Executive General Manager for Conduct Unbecoming a Member
(a) If the offending Member breaches the Rule 1.7(h) for a third time (Third Offence), such action shall result in the offending Member being recommended by the Match and Greens Committee, to be provided with further disciplinary action subject to the provisions provided in General By-Law 6.
Exceptions to Rule 1.7(h)
The following exceptions to compliance with Rule 1.7(h) are provided only with prior written approval by the Match and Greens Committee:-
- During the Sanctuary Cove Professional Shootout event;
- During the Sanctuary Cove Members Shootout event;
- During the Club Championships; and
- Disability
- If a Member has been provided with written approval subject to a disability, such Member must provide the following documents to the Match and Greens Committee:-
- Medical certificate outlining the disability of the Member.
- Provided the Match and Greens Committee has been provided with a medical certificate, the Club will supply Sanctuary Cove branded disability stickers to indicate a Member’s approval to drive within 20 metres but not within 10 metres of the green and tee areas.
- Any other events, circumstances or matters for which the Match and Greens Committee shall provide consent, in writing, prior to the event, circumstance or matter occurring.
4.1 Subject to the exceptions provided in clause 4.1(a), (b) and (c) the following provisions apply:-
- A Member must not drive within 20 meters of any tee box or green area; and
- A Member, at all times when driving near any tee box and green areas subject to clause 4.1(i), must use all reasonable care and caution in order to preserve the tee box and green areas;
- Failure of a Member to use reasonable care and caution subject to clause 4.1(ii) will result in such Member being subject to the disciplinary provisions of Rule 1.7(h).
